SR-22 in Santa Clara: the San Jose courthouses, the DMV suspension and the three-year filing
The Superior Court lists its Santa Clara Courthouse as temporarily closed, so a DUI or other misdemeanor charge from Santa Clara is heard at a county criminal courthouse — the Hall of Justice in San Jose, or the Palo Alto or Morgan Hill courthouse — while the DMV runs its own suspension on a separate track. The SR-22 is what DMV requires before it gives the license back.
Two tracks after a DUI arrest in Santa Clara
The court case. Santa Clara County hears criminal cases at the Hall of Justice, 190 West Hedding Street, San Jose; the Palo Alto Courthouse, 270 Grant Avenue; and the South County courthouse, 301 Diana Avenue, Morgan Hill. Ordinary traffic tickets go to the Family Justice Center Courthouse at 201 North First Street or to Morgan Hill.
The DMV case. The arresting officer sends DMV the suspension order, any license taken and a sworn report, and DMV reviews it automatically. You have 10 days from receiving the order to ask for a hearing, and the temporary license on the order lets you drive for 30 days if your license is otherwise valid. For a driver 21 or older who tested at 0.08% or more, a first offense brings a four-month suspension and a second within 10 years brings one year.
The two do not cancel each other. DMV’s action is independent of any court sentence, and a DUI reduced to reckless driving in court does not lift the DMV suspension.

At the end of the suspension DMV reinstates the license once you pay the $125 reissue fee and file proof of insurance. For a suspension under the DUI sections, that proof has to be an insurer’s SR-22 covering every vehicle registered to you (Vehicle Code 16431); a car in storage, with its plates and registration card surrendered to DMV in Sacramento, is the one exception.
Keep it in force. If the filed proof stops doing its job — the policy cancels or lapses — DMV must ask for new proof and suspend the license again until it is filed (section 16484). DMV may cancel the certificate or waive the requirement at any time after three years from the date the proof was required (section 16480).
